Brighton & Hove City Council is proposing to “clarify and amplify” the reasons it refused to grant consent to the application at next week's Planning Committee. The refusal is the subject of a six week Appeal to the Secretary of State commencing on 3rd November.
The application was considered and refused by the council on 12th December 2008.
The Council is now proposing to remove two of the reasons for refusal and clarify others. Some are being clarified in the light of the new South East Plan which had not been formally adopted at the time of the decision.
The material nuisance and loss of amenity to residents living opposite and within the Marina has been removed as has the risk of flooding.
The housing mix of the proposal has been challenged; the new reasons for refusal include an alleged failure of the development to respond to the city’s identified housing needs.
